سنجش هنجارهای حقوق بین‌الملل فضایی در اجرای صلاحیت کیفری

چکیده

با آغاز فعالیت‌های انسان در فضا، مسائلی هم‌چون حاکمیت، صلاحیت و بسیاری مسائل حقوقی دیگر، تحت بررسی از سوی حقوق‌دانان قرار گرفت. در حقیقت، از یک سو باید پذیرفت پیشرفت فناوری نم‌ تواند با وجود خلأهای حقوقی صورت پذیرد و از سوی دیگر حقوق همواره به سهولت متحول شده و در معرض توسعه قرار می‌گیرد. در این راستا گسترش حقوق بین‌الملل در خصوص حقوق حاکم بر فضای ماورای جو ضروری است. از این‌رو، حقوق بین‌الملل فضایی به مثابة جدیدترین شاخة حقوق بین‌المللی، مفاهیم نوینی را در ارتباط با صلاحیت کیفری ارائه می‌دهد. بنابراین، در این نوشتار سعی بر آن شده تا ضمن تبیین صلاحیت کیفری در نظام حقوق بین‌المللی، جایگاه آن را در چارچوب حقوق بین‌المللی فضایی در موضوعات و مسائل مرتبطی همچون اقتدار فرماندهی، اختیار فرماندهی ایستگاه فضایی بین‌المللی، اختیارات فرمانده و ایستگاه‌های فضایی خصوصی در پرتو معاهده فضای ماورای جو سازمان ملل متحد را مورد ارزیابی قرار دهد.
