چکیده

با آغاز فعالیت‌های انسان در فضا، مسائلی هم‌چون حاکمیت، صلاحیت و بسیاری مسائل حقوقی دیگر، تحت بررسی از سوی حقوق‌دانان قرار گرفت. در حقیقت، از یک سو باید پذیرفت پیشرفت فناوری نمی‌ تواند با وجود خلأهای حقوقی صورت پذیرد و از سوی دیگر حقوق همواره به سهولت متحول شده و در معرض توسعه قرار می‌گیرد. در این راستا گسترش حقوق بین‌الملل در خصوص حقوق حاکم بر فضای ماورای جو ضروری است. از این‌رو، حقوق بین‌الملل فضایی به مثابة جدیدترین شاخة حقوق بین‌المللی، مفاهیم نوینی را در ارتباط با صلاحیت کیفری ارائه می‌دهد. بنابراین، در این نوشتار سعی بر آن شده تا ضمن تبیین صلاحیت کیفری در نظام حقوق بین‌المللی، جایگاه آن را در چارچوب حقوق بین‌المللی فضایی در موضوعات و مسائل مرتبطی همچون اقتدار فرماندهی، اختیار فرماندهی ایستگاه فضایی بین‌المللی، اختیارات فرمانده و ایستگاه‌های فضایی خصوصی در پرتو معاهده فضای ماورای جو سازمان ملل متحد را مورد ارزیابی قرار دهد.

چکیده [English]

Following the beginning of human activities in outer space, such issues as governance, jurisdiction and other legal matters were investigated by jurists. It should be accepted that technological advancement cannot be made possible in the presence of legal gaps, and it should be acknowledged that law is easily changing and developing constantly. With increasing progression law of outer space is essential. humans having access to the outer space, it is extremely essential and important to develop international law governing the outer space and celestial Bodies.
As the most resent branch of international law, therefore, International Space law provides new concepts related to criminal jurisdiction for this reason, present paper attempts to explain criminal jurisdiction within international law system while evaluating its position in the framework of international outer space law on interrelated issues such as command authority, authority of commanding the international space stations, and Command of the International Space Station and commanders in light of U.N outer space treaty
